Terms of Use

1. Introduction

These Terms of Service ("Terms") govern your use of Shay – Hairstyle Studio ("Shay", "we", "us", or "our"), produced and operated by Vision Labs Yazılım Hizmetleri Anonim Şirketi ("Vision Labs"). Please read these Terms carefully. Our Privacy Policy explains how we collect and use information when you use the Shay mobile application (the "Service").

2. Acceptance of Terms

By using the Service, you agree to be bound by these Terms, our Privacy Policy, and any amendments to either. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. Use of Service

When using the Service, you may upload photos to use Shay's AI-powered hairstyle features (e.g., hairstyle try-on, hair color changes, style recommendations, and face-related adjustments). You represent and warrant that you have all necessary rights to upload, reproduce, and distribute such content; that your content complies with applicable laws; and that it does not infringe or violate the rights of any third party.

You remain the owner of your content. You grant Vision Labs a limited, non-exclusive, revocable license to process your content solely to operate and provide the Service at your request.

5. Community Features and User Content

Shay includes social and community features, such as the ability to post hairstyle transformations, follow other users, save content, and interact with posts. By posting content publicly on the Service, you grant Vision Labs a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your public content within the Service for the purpose of operating the community features.

You are solely responsible for the content you post. You agree not to post content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. Vision Labs reserves the right to remove any content that violates these Terms or is otherwise inappropriate, at our sole discretion.

6. Prohibited Uses

You agree not to:

• Upload photos of others without their consent.
• Use the Service to create misleading, deceptive, or harmful content.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code or AI models used by the Service.
• Use the Service for any unlawful purpose or in violation of these Terms.
• Circumvent or disable any security or access-control features of the Service.
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission.

7. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Vision Labs and its licensors. The Shay name, logo, and all related marks are trademarks of Vision Labs. You may not use these marks without our prior written consent.

8. Data Collection and Retention

We collect and temporarily store your photos to provide the Service and delete them when technically feasible. Please see our Privacy Policy for details on data practices, retention periods, and your choices.

9. Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any damages, losses, or harms arising from your use of the Service.

We are not responsible for any misuse of images or photos that you upload using the Service. Your use is at your own risk.

10. Indemnification

You are solely responsible for your use of the Service and your content. You agree to indemnify, defend, and hold Vision Labs (and its affiliates, officers, directors, employees, and agents) harmless from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your content, your misuse of the Service, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

12. Changes to Terms

We may change or modify these Terms at any time at our sole discretion. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. In-App Purchases and Subscriptions

Shay offers in-app purchases and subscription services ("In-App Products") for a fee. All purchases made through the Service are governed by the Apple App Store or Google Play Store payment terms, conditions, and policies. You must accept and adhere to the applicable platform's terms.

Subscriptions are billed upfront on a recurring basis (e.g., weekly or monthly) and automatically renew unless auto-renew is turned off at least 24 hours before the current term ends. You are solely responsible for managing and canceling subscriptions via your app store account settings.

Any unused portion of a free trial is forfeited upon purchase of a subscription.

All sales are final. No refunds (partial or full) are provided for unused credits, early cancellations, or unused portions of a subscription term. Deleting your Shay account or uninstalling the app does not cancel your subscription. You must cancel through your app store account settings.

Vision Labs does not process payments directly and is not responsible for payment processing, refunds, or credit adjustments. All payment transactions and refund requests are handled exclusively by the respective app store. For payment-related inquiries, contact the app store support.

By purchasing any In-App Products, you agree to pay all associated fees and applicable taxes incurred by you or others using your account. We may modify prices for products and services available through the Service at our discretion and without prior notice.

14. Consent to Share Consumption Data

By using the app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple or Google to help assess refund requests. This may include information about how you accessed and interacted with purchased content. We share such data only as necessary and in compliance with the respective platform's policies.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.
